Overview

Independent Mental Health Advocacy is a statutory service provided under the Mental Health Act 1983.

The role of an Independent Mental Health Advocate

An IMHA is independent, trained to work within the framework of the Mental Health Act to represent the person and has no part in a person’s treatment or care.

IMHA’s will:

 

Who May Need Independent Mental Health Advocacy

IMHA support is a statutory right for patients detained under the Mental Health Act.

  • Patients being detained under Section 2 or Section 3 for assessment and treatment
  • Conditionally discharged restricted patients
  • Patients subject to Guardianship or Supervised Community Treatment patients
    Other patients (informal patients) are eligible if they are:

  • Being considered for a serious treatment (e.g Neuro surgery)
  • Under 18 and being considered for ECT
